National Women Development Policy 2011: A holy combination of CEDAW charter, the Constitution of Bangladesh and Quran & Hadith?

It has been claimed that the national women’s development policy is the holy combination of CEDAW charter, the constitution of Bangladesh along with the Quranic scriptures. Now, the questions is, is it possible to coordinate these three at all? Could such bizarreness bring women’s empowerment at all?

Our Digital state is busy making policies and regulations.  We have already got a bunch of them. Education policy, Labour Law, Health Policy, Coal policy, Gas policy, PSC draft and the list goes on. Now we’ve got one more on the list: the National WOmen Development Policy, which would be our subject of discussion for today.

The National Women Development Policy (1st section, 1st chapter) begins by stating that women constitute a massive part of the population of the entire country’ and thus, Women’s empowerment is an integral pre-condition for the national development of the country. It is vital to ensure equal rights and equal opportunity for all women in order to escalate national development.

It is to be noted that Chapter 4.1 of the first section of the policy is titled as, “Charter for eliminating discrimination against women” (CEDAW charter). Clause 17.2 of the second section states the vitality of taking necessary action to eliminate discrimination against women. The 5th chapter of the 1st section (Women’s right and constitution) restated the chapter 27th of the constitution: Each citizen is to be considered as equal and is eligible to obtain equal protection from the law of the country. Additionally chapter 27, 28(1), 28(2), 28(3), 28(4), 29(1), 29(2) and 65(3) of the constitution was also mentioned.

It was expected by some that The Awami Leage government might just come up with an historical women policy. At the least, AL would play the role of bit of a genuine progressive. However, the fear of the Mullas always played a role. Well, I was personally being skeptical. As the PM had been seen previously begging for votes while wearing a hijab. We have also seen AL signing agreements with religious fundamentalists like Khelafote Majlish. So it only makes sense  that the so called ‘progressive’ and ‘secular’ nature of AL has been a scam. The big question was: In such context, what difference AL could make with the women’s policy?

Well I got my answer when I got the Women Policy 2011 at my hand. after the hulabaloo crated by the likes of Amini, the big boys of AL along with the PM herself began to justify their stand by saying it over and over that the Women’s Policy does not contradict with the Islamic scriptures.

The attitude of AL in this particular matter made it clear that AL is after Muslim votes than the progressive votes. Though there is nothing new in this phenomenon, however, what is comical is AL’s confirmation that women’s policy does not contradict with the scripture.
It’s been even claimed that it is going to established the clauses of SIDOW as well.

Now a valid questions is: can one implement SIDOW act in the light of  religious scriptures?
The CEDAW act reaffirms the necessity of eliminating inequality against women at all possible levels. Do the scriptures share the same piece of ideals? Well, it would be fair to say that the scriptures in fact accommodates such inequality, while downgrading the status of women, which indicates their position in two opposite spectrums.

Now, let’s talk about the compatibility of Quranic scripture and the constitution of Bangladesh. Chapters 27, 28(1), 28(2), 28(3), 28(4), 29(1), 29(2) of the Constitution speak of equal rights among men and women. Does Quran speaks of the same thing? The scripture does not perceive men and women as equal. According to Islamic Inheritance law, the son gets double of the daughter, one male witness equals to two female witnesses and the man is supposedly entitled to physically offend his wife. This does not go along with the terms of the constitution.  Thus, it is fair to say that the constitution itself suffers from severe contradictions.

The constitution reaffirms Islam as the state religion. It begins with a Bismillah, and supports Muslim Family Law, and Muslim marriage law. The same constitution assures the equality of men and women in the court, in the judiciary process or in the elections.  According to the Women and Children Law, it is prohibited to physically offend a woman or a child. However, the scriptures permit it. So it is clear that the the CEDAW and the constitution cannot work as a supplementary to the scriptures.

Then what is there in the Women’s Policy? How to rate it?

What is there in the National Women Development Policy 2011?

Firstly, lets analysis chapter 4.1 of the first section.  The title goes: Charter for eliminating inequality against women. However, strangely, it only contains the time, the date and the process through which Bangladesh became a signatory of the act.
It seems to proudly claim that Bangladesh has been one of the first 10 countries to sign the charter. Nevertheless, a decade has passed by, inequality still persists at all levels..

4.1. Charter on Abolishing Discrimination against Women
“Convention of the Elimination of All Forms of Discrimination Against Woman (CEDAW) was adopted in the United Nations in December 1979 to eliminate all kinds of discrimination against women in the state, economy, family and in each area of family and social life and it came into effect on 3 September 1981. This document identified as the International Bill of Rights is considered to be a full dress and self contained standard for the preservation of rights of women. In 1984, Bangladesh ratified this charter and protected in four sections: [2, 13(a), 16(a) and (f)]. Later, protections were withdrawn from 13(a) and 16.1 in 1996. Bangladesh submits report to the United Nations every 4 year as ratifying state to the Charter. The latest 6th and 7th periodic reports were sent to the United Nations in 2009 and the report of GoB was presented at CEDAW Committee on 25 January 2011.

Bangladesh has actively participated in almost all the forums in the international arena and involved her in the global thoughts in the matter of women development by signing important international charters and documents. Bangladesh expressed her commitment in the attainment of Millennium Development Goals (MDG) as it participated in the Millennium Summit Session held in 2000. And at the same time Bangladesh signed also the optional protocol on CEDAW. Bangladesh ranked as one of the first 10 countries in signing the protocol. In addition, Bangladesh has expressed her commitment in undertaking multilateral steps in areas of women development as a ratifying and signatory state to various other important regional charters.”

In 1984, Bangladesh ratified this charter with protection in four sections: [2, 13(a), 16(a) and (f)]. Later, protections were withdrawn from 13(a) and 16.1 in 1996. That means, still protections in sections 2 and 16(a) have not been withdrawn. The logic behind the protection in sections 2 and 16 (a) is that they are against the scriptures of Quran and Sunnah!

Let’s have a look on article 2 and article 16 (a) of CEDAW charter:
Article 2
“States Parties condemn discrimination against women in all its forms, agree to pursue by all appropriate means and without delay a policy of eliminating discrimination against women and, to this end, undertake:
a.      To embody the principle of the equality of men and women in their national constitutions or other appropriate legislation if not yet incorporated therein and to ensure, through law and other appropriate means, the practical realization of this principle;
b.      To adopt appropriate legislative and other measures, including sanctions where appropriate, prohibiting all discrimination against women;
c.       To establish legal protection of the rights of women on an equal basis with men and to ensure through competent national tribunals and other public institutions the effective protection of women against any act of discrimination;
d.      To refrain from engaging in any act or practice of discrimination against women and to ensure that public authorities and institutions shall act in conformity with this obligation;
e.       To take all appropriate measures to eliminate discrimination against women by any person, organization or enterprise;
f.        To take all appropriate measures, including legislation, to modify or abolish existing laws, regulations, customs and practices which constitute discrimination against women;
g.      To repeal all national penal provisions which constitute discrimination against women.”

Article 16
“1. States Parties shall take all appropriate measures to eliminate discrimination against women in all matters relating to marriage and family relations and in particular shall ensure, on a basis of equality of men and women:
a. The same right to enter into marriage;”

It is to be noted that article 2 is the principal foundation of the CEDAW charter. And therefore, it hardly makes sense to be a signatory of CEDAW while skipping the clauses of Article 2.

On the other hand, Article 16 speaks of laws regarding marriage and divorce. It specifically mentioned the equal rights among men and women in matters relating to marriage.  However, due to the fear of going against the scripture, this particular part was omitted as well.
Now isn’t it clear that a range of incompatible and contradictory clauses are found in CEDAW and the Islamic scriptures? Same applies for Women Policy as well.
They are speaking of Equal rights while skipping article 2 and 16!

Just after article 4.1 of Women Policy-2011, we will get article 5: Human Rights of Women and the Constitution. There articles 27, 28 (1). 28 (2), 28 (3), 28 (4), 29 (1), 29 (2) and 65 (3) of the constitution of Bangladesh have been stated.
Article 28 (1):
“The State shall not discriminate against any citizen on grounds only of religion, race caste, sex or place of birth”.
Article 28 (3):
“No citizen shall, on grounds only of religion, race, caste, sex or place of birth be subjected to any disability, liability, restriction or condition with regard to access to any place of public entertainment or resort, or admission to any educational institution.”

Article 28 (4):
“Nothing in this article shall prevent the State from making special provision in favour of women or children or for the advancement of any backward section of citizens.”

Article 29 (1):
“There shall be equality of opportunity for all citizens in respect of employment or office in the service of the Republic”

Article 29 (2):
“No citizen shall, on grounds only of religion, race, caste, sex or place of birth, be ineligible for, or discriminated against in respect of, any employment or office in the service of the Republic.”

It is nice to go through such fancy articles. However, the implementation of it is far from reality. For instance, most of the articles are written during 1972. The matter of the fact is our constitution is filled with self-contradiction. If we could rightfully apply the constitutional clauses, Religious scripture based Family Inherence Law 1925, Family court Ac 1985, and amendment 1989, or marriage related laws are not supposed to survive by now. However, strangely, in the case of distribution of inherited property, the use of Muslim Family Law(son gets double) or Hindu Law (daughters get nothing) has outlawed the Universal family code Law.

Interestingly, though the Witness act 1972, and Agreement Act 1972 has acknowledged the equality among men and women, according to Muslim Marriage Law, 2 female witness is to be counted as equal to 1 male witness. Even more outrageously, it outlawed the necessity of a female witness, in case of a presence of two male witnesses.

It is to be noted that most constitutional clauses related to the the Women Policy were actually written in 1972. Nevertheless it continued to remain unchanged for the last 41 years. This is the same constitution which accommodates Muslim-Hindu-Christian Marriage Law, or the Inheritance Law. The matter of the fact is keeping religious clauses alive and aiming for women’s right and equality does not really make sense.

Let’s look at the second section of the Women’s development act. The aim of the women policy is stated as: “to ensure equality of men and women in all sectors in light of the Bangladesh constitution.” However, as we already discussed, the contradictory nature of the constitution itself inhibits the struggle against inequality.

Let’s come to the 2nd chapter. This chapter could be considered as the most important stride.
16. The objectives of National Women Development (22 points)
17. Making sure Women's Human Rights and Fundamental Rights (9 points)
18. Development of Female Children (8 points)
19. Elimination of all kinds of Children Abuse (11 points)
20. Armed Conflicts and the State of Women (3 points)
21. Education and Training (3 points)
22. Sports and Culture (4 points)
23. Ensuring Active Participation of Women in All National Economic Activities and Equal Rights (11 points)
24. Elimination of Poverty of Women (5 points)
25. Economic Empowerment of Women (2 points)
26. Employment of Women (6 points)
27. Making Gender Responsive Budget and Gender Disaggregated Database (3 points)
28. Support Services (1 points)
29. Women and Technology (3 points)
30. Food Security of Women (3 points)
31. Women and Agriculture (4 points)
32. Political Empowerment of Women (9 points)
33. Administrative Empowerment of Women (7 points)
34. Health and Nutrition (11 points)
35. Housing and Shelter (3 points)
36. Women and Environment (3 points)
37. Security and Safety of Women and Children in Pre, Post and During Disasters (10 points)
38. Special Programs for the Women of Backward and Small Ethnic Groups 3 points)
39. Special Program for Disabled Women (6 points)
40. Women and the Mass Media (4 points)
41. Particularly Vulnerable Women Group (1 point)

Most of these issues either have already been placed in the formal law books or received ideological support from the state level. However, the implementation part has been neglected as it is. (For instance, the issue of eradication of poverty of women, addressing existing inequalities among men and women, establishing human rights for women, and eliminating all kind of torture against women and girl children). Unfortunately, so far we have not seen the ‘big talk’s getting translated in the ground.

Let’s look at Clause 17.5 of the chapter on human rights for women. Its about Not to make any kind of statements or take actions, either at local or state level, based on wrong or misleading explanation of the religious scripture.

I wonder why in the world the gangs of Amini had to create so much uproar against the Women’s Policy anyway.  Despite of the fact that even the high court of the country ruled against Fatwa (waiting for the verdict of the appeal board), this Women’s Policy could not demonstrate the minimum courage to outlaw Fatwa.

Let’s read a part of it. Its saying, based on wrong interpretation of the religious scripture” one cannot take actions or make statements or take actions which go against the interest of women.
What does it really mean by based on ‘wrong interpretation of the religious scripture’? Then what is exactly the ‘right interpretation of the religious scripture’? Or they actually believe that ‘the right interpretation of the scripture’ is always pro-women anyway?

Interestingly, following the publication of National Women’s Development Policy 2011, the family inheritance law was the most targeted one. Mullas from all walks of life began to roar. The fear war clear:  To block any law that ensures the equal distribution of inherited property. A range of debates have taken place over the issue. Even my mother was complaining one day: ‘Even the educated ones are not willing to understand’.  Apparently a few old logics have been used over and over in favor of the inheritance law: Its costly to get a daughter married, she leaves home after marriage anyway, … and she is hardly making any losses as she is getting the husband’s portion as well, and etc.

Now, it is important to note that I could not find a single clause in the Women’s Policy that talks about ‘inheritance’ and ‘equal right’ simultaneously. Women’s Policy 2011 contains few clauses which give a false impression of equal rights over the inheritance.

To ensure equal opportunity and partnership of women in property, employment, market and business and to ensure rights of full control over the assets earned through inheritance, loans, land and market management.

Interestingly, according to the provisions of 23.2, property does not merely indicate inheritance. Article 25.2 has mentioned inherence, however the term ‘equal rights’ is missing. Instead it talked about ‘full control of women’. Clearly, it does not indicate anything regarding the nature of distribution of property, rather ensuring women’s full control over the already distributed property. This is scam itself. It is only good for creating an eye-wash of equality.

So, first we have seen the ruling party creating an eye-wash of ‘progressiveness’ by propagating the Women’s Policy as a genuine change maker.  Yet, the moment the Mullahs made an issue out of it, they began to justify it by saying, the policy does not contain anything that is contradictory to Islam

There is nothing much to say regarding the statements of the Ministry of Religion. Something that is noticeable is the over-use of the Arabic terms ‘Bismillah’ and ‘Assalam’, indicating a purely hypocratic face of the so-called Secular Awami League.

Well, if we remember, it is the same party that once aliened with Islamic parties like Khelafat Mazlish. It even once attempted to ‘halalazied’ Fatwa. And some of us are still under the impression that they are ‘Secular’ and ‘progressive’!

I personally feel, the stature of women would not change. This Women’s Policy thingy is nothing more than a strategy to get some attention from the donors. Also the NGOs might have a role to play here.  No matter what it intends to do, I don’t feel much optimistic about it. Meaningful development and equality for women would require a ‘human’ status to women. And it is only possible when the patriarchal superstitions would be dissolved. However, since the male-made religious scriptures support and accommodate such patriarchy, the only way to achieve equality for women is to take a bold stand against all such religious conventions, whether Quranic, Vedic,  or Biblical. Obviously, the Women’s Policy 2011 was not bold enough to take the challenge. However, the claim, that it was women policy -2011 which initiated all kinds of equal rights convention, is misguiding. On the contrary, our old achievements of the movement on women rights have been downgraded as the ruling party’s attempt to appease the Mullahs by ensuring them that there is no conflict between this policy and Quran & Hadith, has weakened the morale of the ongoing women’s movement. At the end of the day, only the conviction is re-established that you can’t go against the scriptures.

Science in Religion: Expecting mangoes from a Neem Tree

Let’s start with a mythology- you can find it in the Mahabharata and also in the Bhagabata! When the gods were about to drink nectar (Amrita in mythology- you would live forever after drinking it) by churning the sea, then one of the demons Rahu in the disguise of a god also started drinking it. But when the gods Sun and Moon identified Rahu all on a sudden, they informed the other gods and King Indra beheaded Rahu with a single stroke. Right at that moment the liquid Rahu drank had reached up to his throat that’s why the ampulated head became immortal and used to stay in a place in the sky. As Rahu was caught due to the Sun and the Moon, his relation with them became very hostile and and whenever these two come in touch with Rahus position while circulating around, Rahu swallows them up. And the duration in between which Sun or Moon is inside Rahu’s throat is called solar eclipse or lunar eclipse.

We can cite many such stories in fables of different places, mythologies and ancient tales where efforts to explain the incidents around nature had been made. These remind us of how the ancient people tried to imagine the causes behind effects. But problem rises exactly when man starts blindly believing these myths wrapped in his or her own religion and tries to give it a universal shape. And to do that in today,s era of science, many make a link of these myths with the acceptable scientific explanations. I found such an explanation of the above incident in a discussion. Here it is:

In Bhagabata, ‘’Ampulated head of rahu became immoral as it came in touch with Amrita. That’s why Brammya acknowledged Rahu as a shadow planet. As Rahu is the eternal enemy of the Sun and the Moon, he runs towards them during new moon and full moon days.’’ (8/9/26). Or ‘’Rahu is inimical both to the Sun and to the Moon and so he tries to cover them during those days.’’

Immediatety after saying this, they brought in the scientific theories of Lunar and Solar eclipses to the discussion table and after showing some bizarre similarities, they came to the conclusion that Rahu is the shadow that falls upon the Moon. Lunar eclipse or solar eclipse does not occur in every Full moon day or New moon day respectively. They occur only when Rahu’s shadow falls upon them. So every explanation of modern science is inside the Bhagabata.

Scientific Explanation of Religion:

You do not need to think much of what the purpose of finding science in religion, or evolving scientific explanation of the religious myths or searching the modern discoveries and inventions in the Holy Scriptures. Mankind has passed a long time since the evolution of religion. It was not possible to confine people fully in spite of killing Copernicus-Bruno-Galileo-Hyphesia, temporarily shutting down practice of knowledge by exercising muscle power and burning libraries. Today mankind tries to ignore the superstitions of thousand years over and again. On the other side, superiority of every religion is getting challenged. So for the survival of every religion, a blending with science has become a must. That is how religions become scientific and the Holy books as scientific encyclopedia.

Quran: ‘’Then I am showing examples. Those stars that go back.’’ (81/15)
Science: All the galaxies far from here are going and spreading away from our galaxy Milkyway. In 1920’s Edwin Hubble by scientific inventions found that the other galaxies are always moving back.

Quran: ‘’It is Me who have created the skies by force and definitely I am expanding it.’’ (51:47)
Science: All other galaxies far from us are constantly moving back in all directions. That implies the Universe is expanding.

Quran: ‘’Don’t the nonbelievers see that the Heaven and the earth and everything were in a concentrated condition, later I separated them from each other.’’ (21:30)
Science: The Universe is constantly expanding which implies earlier in the beginning every planet, star and every matter were closely-knit. Later some possible initial explosion has created this ever-expanding Universe.

Quran: ‘’Then He paid attention to the sky-it was smoke then. Then He said to the Sky and Earth, ‘Come, Willingly or unwillingly’. They said, ‘we have come fully loyally.’’ (41:11)
Science: In the beginning of creation, there was a mixed smoke of Hydrogen and Helium. Due to some unknown reason, this smoke divided and formed huge cluster or clouds of smoke. Later each cloud of smoke has transformed in to a galaxy. This galaxy, the other galaxies and the whole universe was created from smoke.

Quran: The sun is moving at its own axis. This is defined by Allah almighty. I have set the Moon in its proper place even it turns in to thin palm leaf. The sun cannot catch the moon and the night cannot catch the day. They are moving at their respective axes.’’ (36:38, 39, 40)
Science: The sun is moving at its own axis constantly. Everyone is moving in their respective axes, each axis is different. The sun is in the middle of them.

Quran: ‘O company of jinn and mankind, if you are able to pass beyond the regions of the heavens and the earth, then pass. You will not pass except by authority [from Allah ].’’ (55/33)
Science: So the conquest of space is also indicated in 33rd Aayat of 55th Surah in the Quran. That is, as Allah said, you can enter into that region only after attaining super velocity. Needless to say, super velocity is something like attaining the high speed technology by overcoming the gravitational barriers through science and technology. During the end of the last century mankind had grasped the technology and successfully landed on the moon.

Just delving into a deeper will reveal that two things are consciously done by such scientification- two aberrations- first in the translation, second in the explanation. For example:

Translational aberration: From the above example, we see that 81:15 and 15 are translated as thus: ‘’Then I am showing examples. Those stars that go back.’’ From Jahurul Haque’s translation we get,’’I admit stars and planets as witnesses. Those we move and vanish.’’ Let’s look into three more translations,
"YUSUFALI: So verily I call to witness the planets - that recede, Go straight, or hide;
PICKTHAL: Oh, but I call to witness the planets, The stars which rise and set,
SHAKIR: But nay! I swear by the stars, That run their course (and) hide themselves,"

Similarly 51:47 is translated as thus, ‘’It is Me who have created the skies by force and definitely I am expanding it.’’ As per Jahurul Haque, it is like, “And the space- we built it by hand and we are the creators of grandeur.” In the English version, we get,
"YUSUFALI: With power and skill did We construct the Firmament: for it is We Who create the vastness of pace.
PICKTHAL: We have built the heaven with might, and We it is Who make the vast extent (thereof).
SHAKIR: And the heaven, We raised it high with power, and most surely We are the makers of things ample. "

Let’s come to the Aayats regarding the motion of the sun and the earth. In 36:38 it is ‘’ the sun is moving at its own axis.” As per Jahurul Haque, “The Sun roams at its path of destination.” And in English
"YUSUFALI: And the sun runs his course for a period determined for him:
PICKTHAL: And the sun runneth on unto a resting-place for him.
SHAKIR: And the sun runs on to a term appointed for it."

There are so many examples like this, you also can easily find out by matching several translations.

Explanatory aberrations: It is more fun, because the biggest fraudulency is in here. If you consider ‘the suns and planets retreat’ even instead of ‘run their course (and) hide themselves’ and link it with Hubble’s discovery of galaxy Milkyway’s spreading away from the other galaxies, I can’t understand how to laugh at you! And in the explanation of ‘’ The sun cannot catch the moon and the night cannot catch the day. They are moving at their respective axes.’’ (36:40) it is said that the earth and other planets are moving round the sun in their respective axes, then I feel I need to learn the grammar anew. Question raises- the Pronoun which replaces the Noun indicates whom? And when one finds the big bang theory in the explanation of “the Heaven and the earth and everything were in a concentrated condition, later I separated them from each other.’’ (21:30), then I think not existing now, but there must be something like sky at the very beginning of the universe as per Quran. I read the big bang theory once again to find if the earth is created in the very beginning. When in the explanation of ‘’ O company of jinn and mankind, if you are able to pass beyond the regions of the heavens and the earth, then pass. You will not pass except by authority [from Allah ].’’ (55/33) it is said that man’s exploration to the moon had been professed in Quran, I cannot stop laughing- it remembers me of the story when a less educated rural youth translated the Telegram as he understood and read it to illiterate villagers.

Science versus Quran: Fun not ended. Another funny thing is so many Suras, Aayats and Hadiths remain unfocused during such discussions. Similarly other acknowledged discoveries of science are also kept hidden. And if some accidentally brings those to table, Fatwa is immediately imposed upon him or her-‘Bigots like us will never understand the Quran and Hadiths, some are beyond human imaginations.’’ And sometimes attack on science directly-‘Science cannot know everything ever.’ At the same time endeavors to link science and Quran do not decrease.

However, let’s discuss some Quran-Hadiths ignoring those fatwas:
Until, when he reached the setting of the sun, he found it [as if] setting in a spring of dark mud, and he found near it a people. Allah said, "O Dhul-Qarnayn, either you punish [them] or else adopt among them [a way of] goodness."(18:86)

Until, when he came to the rising of the sun, he found it rising on a people for whom We had not made against it any shield. (18:90)

Here narrator Allah is telling about Dhul-Qarnayn-he went to the sun rising place once and the sun setting place once. And he saw the sun setting in to the black water. Question rises- didn’t the Arab people know at that time that the earth is round? Because two places are needed at two sides for sun rising and setting when only the earth is considered plain.

Let’s look into some other Aayats that are very doubtful:
And We placed within the earth firmly set mountains, lest it should shift with them, and We made therein [mountain] passes [as] roads that they might be guided. (21:31)

And We made the sky a protected ceiling, but they, from its signs, are turning away. (21:32)

And the earth - We have spread it and cast therein firmly set mountains and caused to grow therein [something] of every well-balanced thing. (15:19)

A spring of which the [righteous] servants of Allah will drink; they will make it gush forth in force [and abundance]. They [are those who] fulfill [their] vows and fear a Day whose evil will be widespread. (76:6,7)

[He] who made for you the earth a bed [spread out] and the sky a ceiling and sent down from the sky, rain and brought forth thereby fruits as provision for you. So do not attribute to Allah equals while you know [that there is nothing similar to Him]. (2:22)

He created the heavens without pillars that you see and has cast into the earth firmly set mountains, lest it should shift with you, and dispersed therein from every creature. And We sent down rain from the sky and made grow therein [plants] of every noble kind. (31:10)

When I read these, I should forget what modern science says about the space and the universe. When I look at the ever moving stars in the universe, then the sky stated in Quran which Allah has created without any pillars and which has 7 more layers, I get very much confused. And creating the earth as a plain bed, He has set mountains in it- which is why the earth does not incline or move. These are indeed great mercies of Allah but when now it is clearly evident that the earth not only moves in spite of having mountains, rather it is dancing around the sun I n every 365 days and dancing in its own orbit in every 24 hours – it makes me very much doubtful about the knowledge of Allah.

Let’s look into the Aayat 36:38 which is translated by PICKTHAL as "And the sun runneth on unto a resting-place for him" Let’s find this resting place in original Bukhari Hadith:

Narrated Abu Dhar:

The Prophet asked me at sunset, "Do you know where the sun goes (at the time of sunset)?" I replied, "Allah and His Apostle know better." He said, "It goes (i.e. travels) till it prostrates Itself underneath the Throne and takes the permission to rise again, and it is permitted and then (a time will come when) it will be about to prostrate itself but its prostration will not be accepted, and it will ask permission to go on its course but it will not be permitted, but it will be ordered to return whence it has come and so it will rise in the west. And that is the interpretation of the Statement of Allah: "And the sun Runs its fixed course For a term (decreed). that is The Decree of (Allah) The Exalted in Might, The All-Knowing." (36.38)

You can imagine Allah and his Rasul’s knowledge from this simple example. There are more examples-overwhelming. There are no differences between Jinns , Angels and the monsters in fairytales. Moreover diving the river into two parts, traveling to seventh heaven by Borak, stick becoming a snake, curing leprosy by hand touch- all these are simply funny myths-please don’t draw science in it.

Same things in other scriptures:

Now let’s find something funny from Hindu scriptures:

Bhagabata 2/16/17: Oh Mother! Daughter of the self-creator Monu! I have previously described that time is the power of Holy God, equilibrium of nature, agitated from an undisclosed condition that began creation.

Science: ‘agitated’ means exploration. Scientists say the universe was created from a big exploration which is called big bang.

Bhagabata 3/20/16: a bright lotus stemmed from Lord Brishnu’s navel, like one thousand suns. This lotus is the origin of all lives and the first creature the all-powerful Brahmma came out of that lotus

Science: Stiffen Hocking in his book ‘A brief history of time’ has discussed it is seemed that at the time of explotion the volume of the universe was zero and temperature was infinitive. With the expantion of the universe, temperature decreased to 10000 million degree Celsius which is thousand time powerful than the heat in the core of the sun. As it is described in the Bhagabata the temperature after explosion was thousand times that of a burning sun was later described by scientists.

Scanda Puranam 38/54: Oh the sons of Bharata! Clouds are created from smog and stream of the sea. So it becomes blue when full of water and can rain.

Science: Todays scientist tell about watercycles as reason the of railfall, which was actually mentioned in the Scanda Puranam.

Bhagabata 2/7/37: in the Koli era, atheist demon like super scientists will become very knowledge by studying Veda and will invisibly move around the space by spaceships.

Science: Koli era means the present time. So it can be said that the spaceships scientists are making nowadays had been professed long ago in the Bhagabata.

So examples are many. Same for the Bible also. Muslim readers may find these examples hilarious, irrational, funny and everything, but basically there is no difference between these examples and Quranic examples. The same thing- translational and explanatory aberrations. Let’s finish this topic with one last comparative example:
Quran: Then We placed him as a sperm-drop in a firm lodging. Then We made the sperm-drop into a clinging clot, and We made the clot into a lump [of flesh], and We made [from] the lump, bones, and We covered the bones with flesh; then We developed him into another creation. So blessed is Allah, the best of creators. (23/13, 14)
Bhagabata 3/31/2: When the sperm enter into the overy, first night ot gets mixed with the blood, becomes a bubble in fifth night and with times becomes a piece of flesh.

Both versions try to prove their superiority by linking themselves with science but modern embryology simply turns down all these fake explanations from all holy books.

Story of an illiterate 1400 years ago:
One very important question is thrown to everybody after all such discussions: “Can you imagine how an illiterate man 1400 years ago in Arab came across these thoughts? What modern science is discovering today has been uttered by an illiterate man 1400 years ago. This proves that Quran is not man-made, it is divine.”

Well said. But we wonder when we find some more important discoveries in the history of mankind. 200 years ago before this 1400 years (100 years ago of Copernicus) Arzabhatta )(476 AD) declared that the earth is round, it moves round the sun and also at its own axis. Aristotle 2000 years ago said object will stay in the same place in vacuum or move at the same pace constantly. (Aristotle however failed to prove his assumption and rather refused to uphold his statement thinking that there will not be any vacuum.) Bhaskaracharza 500 years ago before newton said right things about the gravitational force.

All these things make me think- man can provide us with correct knowledge before Allah. And Allah blessed us with knowledge not in a straight forward way rather spirally and also with so many mistakes. Why Allah in spite of writing Quran in his own hands, failed to state directly that- the earth moves round the sun- it is simply regrettable!

Support the Bangladeshi Free-thinkers and Atheist Bloggers! Extend Your Helping Hands to Humanity!

We are freelance writers from Bangladesh. Most of us have started our writings through blogging in 2006 and 2007 when a Bengali blog, called, ‘somewhereinblog’ (www.somewhereinblog.net), was first founded. Somewhereinblog has appeared as a wonderful opportunity to express and share our experiences, daily diaries, our happiness and sorrows in our own language/terms. Initially we have used the space to read blogs, while some of us were sharing personal diaries, literary works i.e. poetry, short stories, travel blogs etc. At some point we have noticed random posts on Islamic thoughts and inserts from Quran & Hadith, translated by apparently preaching articles from so called Islamic scholars abroad. These were not one off incidents, rather those were regular posts by religious and Islamist writers. In reading those articles, we wondered if religious writers or Islamic authors are able to share their religious speeches, why shouldn’t we? We believed that even if non-believers we should have the right to talk about our thoughts and reasons for unbelieving when the believers and religious authors have the right to preach through social media. Hence we started to express our thoughts and views through blogs. As atheists our blogs contained the non-traditional thoughts, the logic of being skeptical, and the story behind unbelieving. This simultaneously appeared as counter-logic to the believers. Many of us have started to argue that about some Islamic articles which were posted by the blind-believers. Both logic and counter-logic went on in the section for comments. We were soon thrilled by e-meeting and discovering so many supporters, friends, free-thinkers, atheists, non-believers, and agnostics around us. It was totally unexpected yet amazing to come across these many non-believers with us at that time. We could have hardly imagined that so many atheists and free thinkers had existed in the country as ours, from where writers like Taslima Nasrin and Daud Haider were exiled!

We started to write blogs on faithism, on the history of religions, philosophy of religions, and scientific outlook of religions. We started to ask various questions on the issue of women’s rights and the issues of justice and rights within religions. At the same time, we had begun to debunk the unscientific claims of the religious texts and religious. Our interest covers history, philosophy, science, feminism, law, culture, art-culture and, of course, humanity. We wrote several articles on these subject-matters. We have great interest in ancient Indian philosophy since we have found there are lots of atheist sects of our ancient philosophy like Sankhya, Mimangsa, Buddhism, Charbak, Jainism etc. We have started to publish short articles or inserts from prominent free thinkers, writers, like Aroj Ali Matubbar, Dr. Humayun Azad, Ahmed Sharif and more.

Later on we came across the web-site, called Muktomona - Freethinkers (www.mukto-mona.com) which was founded in 2001. It was a great discovery for us again when we came to know that writers of such a site are mainly people of Bangladeshi origins. Initially it was not a blog. There was no comment option on the site. We needed to send our articles via mail. We have spent time mostly to debate and argue with the Islamists in somewhereinblog though mukto-mona was like our own home-base. Through this home-base we have obtained an identity as “mukto-mona” – free thinker, someone who holds a free mind and who is open to debate and discussions about anything. There we found many other friends, among whom muktomona blogger Avijit Roy was the most influential for his new and creative writings. He had soon become a good friend, our guide and a wonderful senior fellow. Gradually some more Bengali blogs came on the web. Sachalayatan, for instance, became most powerful among others. Also Amar blog, cadet blog, nagorik blog, ishtishon became popular and many of our atheist bloggers were scattered in different platforms of blogs. But somewhereinblog had still a special role as an open platform where both the religious and atheist bloggers used to write and where many Islamic bloggers freely took part on the discussions and debates with us. Over time somewhereinblog lost its popularity as many other blogs came into scene, and as facebook took over the place of blogs for many bloggers. The Dhormockery became another major initiative for the atheist bloggers where various satires and cartoons on religions were published.

From the beginning of our writings in blogs and facebook, we were faced with unexpected angry words and annoyance of the religious people, especially from the Islamists. Some of us have used to write in disguise under “nick name” butsome used to write with their original names. The Islamic fanatics often offered us to dare not to write in disguise which actually made us take the decision to continue under the nickname. On the other hand, bloggers with real name and identity were often asked to share their address! Sometimes Islamic extremist people used to show their doubt about the originality of the identity of us, who were writing in real name! They used to remind us the almighty’s threat after and before death. We did never bother about so-called heavenly threats, but sometimes we felt worried when it seemed that these guys were somehow willing to see the almighty’s threat to be applied upon us in this very world!

As stated earlier, from the beginning of our writing on religion, history, philosophy, humanity and atheism, we used to receive very angry and furious responses from some fanatic religious persons. Especially our articles on Islam, Quran & Hadith and Muhammad made them almost mad. We always  ried not to show any disrespect towards their belief, on the contrary we used to discuss the economical and political situation under which Muhammad had become Muhammad, the prophet. Sometimes we tried to debunk false claims about Quranic explanations of some Islamic scholars like Zakir Nayek, Ahmed Deedat etc instead of hitting Quran directly. Still these articles made some of them very angry. In the comment section of these blog posts or via facebook messages, they used to show their reactions. They scolded us out of hatred, declared our ultimate punishment after death. They wished our complete destruction. Initially we took such reactions as normal behavior of believers. We overlooked their  eactions as we thought that these were only reactions which came out of instant anger. We preferred not to bother them at all. But in 2013, the situation took a sudden turn and got rapidly worse. Below are  the major incidents (chronologically) that happened in the year 2013:
1. On 14 January, 2013, Atheist blogger Asif Mohiuddin was stabbed by unknown attacker, somehow he survived.
2. On 5 February, 2013 the Shahbagh Movement began.
3. on 15 February, 2013, Ahmed Razib Haider, one of the activists of Shahbagh Movement (Thaba Baba on blog) was murdered by identifiable killers .
4. From the very moment of Rajib’s killing and soon after the Shahbag public demand for justice for Rajib, his writings especially satires on Islam, Muhammad, Quran and Hadith were systematically brought in public and made available through various Islamic pages of facebook, Islamic websites as well as the national media including the Daily Amar Desh, Daily Sangram and so on), backed by Islamic nationalist parties. Propaganda against aetheists and Rajib was being spread all over the places within the country. Extreme hatred against atheist bloggers was being successfully raised at mass level. Islamic leaders called for capital punishment for the atheist bloggers. Eventually Hefajot-E-Islam, an organization of Ulamas, Islamic knowledgeable persons, from the Qawmi madrashas, Islamic educational institutes, took on the lead to the country-wide agitation.
5. Hefajot-E-Islam declared a 13 points-demand against atheists which include below:
· Reinstate the phrase “Absolute trust and faith in the Almighty Allah” in the constitution as one of the fundamental principles of state policy.
· Pass a law keeping a provision of capital punishment for maligning Allah, Islam and Prophet Muhammad and smear campaigns against Muslims.
· Punish the “atheist” leaders of Shahbagh, bloggers and anti-Islamists who make “derogatory comments” about Prophet Muhammad (pbuh).
6. Hefajat-e-Islam declared to organize a long march towards the Motijheel area in Dhaka from Chittagong, Sylhet and Rajshahi to push for their 13-point demand on April 6, 2013.
7. 3 Bloggers Subrata Adhikari Shuvo, Russel Parvez and Mashiur Rahman Biplob were arrested on April 2 2013, under Section 54 of the Code of Criminal Procedure on suspicion of making derogatory comments about Islam. The 4th blogger, Asif Mohiuddin was arrested on April 3 2013. In the behind of the scene, government was trying to negotiate with these Islamic groups including Hefajot-E-Islam.
8. List of atheist bloggers was published. It started sporadically after the killing of Rajib. Several Islamic groups published in different Islamic websites and also in some of print media. The lists published were also of different types (different groups listed down 26 atheist bloggers, 42 bloggers, 56 bloggers differently). On 31 March, 2013 an investigation committee of the Prime Minister’s Office held a meeting with ‘Islamist’ scholars. During the meeting with the committee at the Home Ministry, these Islamic leaders and or scholars submitted a list of 84 ‘atheist’ bloggers to the committee. Mainuddin Khandaker, Home Ministry’s Additional Secretary and also the committee chief, echoed the scholars during the meeting: “The committee is taking steps to identify for bringing those spreading propagandas to justice”. Just few days after this meeting and also few days before the long march of Hefajot-E-Islam, 4 bloggers were arrested.

9. On 31 March 2013 Bangladesh Prime Minister Sheikh Hasina pledged to punish online insults against Islam. She said: "You (Islamic parties) do not need to go for any movement. As a Muslim, We have the responsibility to take action". http://www.ndtv.com/world-news/bangladesh-pmsheikh-hasina-pledges-to-punish-online-insults-against-islam-517688
10. On May 5, 2013, Hefajat arranged a siege and rally at the capital city, Dhaka in the demand of their 13-points.
11. The cabinet approved the draft of the ICT (Amendment) Act-2013 on August 19 proposing to empower law enforcers to arrest any person without warrant and increase the highest punishment to 14 years from minimum 7 years. The government has later promulgated the ICT (amendment) ordinance.
Article-57: Punishment for publishing fake, obscene or defaming information in
electronic form:
(1) If any person deliberately publishes or transmits or causes to be published or transmitted in the website or in electronic form any material which is fake and obscene or its effect is such as to tend to deprave and corrupt persons who are likely, having regard to all relevant circumstances, to read, see or hear the matter contained or embodied in it, or causes to deteriorate or creates possibility to deteriorate law and order, prejudice the image of the State or person or causes to hurt or may hurt religious belief or instigate against any person or organization, then this activity of his will be regarded as an offence.
(2) Whoever commits offence under sub-section (1) of this section he shall be punishable with imprisonment for a term which may extend to maximum fourteen years and minimum 7 years and with fine which may extend to Taka one crore.

After Rajib’s killing we have realized for the first time that nick name couldn’t guarantee anyone’s safety, and that the Islamic extremists had got the mechanism to identify the original identity of a disguised nick. The Ansarullah Bangla Team, an Islamic fanatic and terrorist group has declared that they were going to kill many more atheists of Bangladesh (https://justpaste.it/Target). Since then we have been trying to be more careful regarding our writings. Most of us slowed up our writings. But just before the long march of Hefajot-E-Islam on 6 April 2013, the situation went even worse. Many lists of atheist bloggers were produced and four bloggers were arrested. These months were very concerning for us and many of us have felt vulnerable within the supposedly secular-state of Bangladesh. We were desperate to find safe and unknown places to hide, mainly to hide from state-security personnel and police since the arrested bloggers were freed.

2014 was a comparatively calm year. We had started to live relatively normal life, though already many of us had become irregular in our online domain, many had removed their blogs. In the year of 2015, following the mixed reaction of Bangladeshi people about the Cahrlie Hebodo Killings, the Islamic extremists started to commit serial killing. They have been following a hit list of 84 atheist bloggers who were found vividly loud about secularism and against religious illogicality. Four radiant atheist bloggers were hacked to death within 5 and half months. First they murdered Avijit Roy, the founder of muktomona. com, then hacked blogger Washikur Rahman Babu to death, and science writer Ananta Bijoy Das and most recently they murdered Niloy Neel, a blogger and the founder member of Science & Rationalist Association of Bangladesh (SRABAN). The local media has published a full list of what they called “those ‘culprit’ 84 bloggers” following the murders each time! The situation is now heightened, as if the remainder of those atheist bloggers who are still surviving and somehow living in the country could be killed anytime. It seems that we are waiting for nothing but a direct machete-attack. Government of Bangladesh has failed to identify and punish the real criminals behind these consecutive incidents of concerted attacks on atheists. Two of the killers were caught by public on spot after the killing of Washikur Babu, but with the help of them no more extremists could be identified. Actually no activities from police administration, special branch or detective branch, ie the government authority can be seen after these incidents. Son of our Honorable Prime Minister told the reason behind this inactiveness while replying to the query of Reuters: “Our mother offered private condolences to Avijit’s father. But the political situation in Bangladesh is too volatile for her to comment publicly…. We don’t want to be seen as atheists.”
http://www.dhakatribune.com/bangladesh/2015/may/11/situation-too-volatile-comment-avijit-murder

It has been found most alarming that instead of helping to confront this outrageous injustice, political and state institutions have begun blaming the victims themselves and making matters worse. Very next day following the murder of Niloy Neel, the Inspector General of Police engaged in victim-blaming, called for self-censorship, and threatened bloggers. Furthermore, the Cabinet Committee for Law and Order, headed by Minister of Industries Amir Hossain Amu, on their 9 August 2015 meeting decided to declare Atheist authors as criminals, thereby making them subject to prosecution, and intelligence agencies have been asked to monitor blogs to find those atheist writers.  (http://www.kalerkantho.com/print-edition/first-page/2015/08/10/254553)

Under the circumstance, we hold no hope for our safety or for the other bloggers listed on the hit list, though we are still living in Bangladesh. Today’s Bangladesh is totally unsafe for the atheist bloggers like us, not only for those Islamic fanatics and extremists but also for the so-called secular government who totally failed to ensure the safety for the bloggers. They are actually unwilling to provide safety in true terms. Although six persons were arrested after the killing of Rajib on 15 February 2013, all of them had got the bail and later released. There is no hope. The opposition party had already allied with several Islamic parties, and they have declared support to Hefajot-E-Islam’s 13 points. Not only this support towards Hefajot-E-Islam, now Awami Olama League, the Islamist wing of ruling party Bangladesh Awami League, has made new demands of death penalties for all atheist bloggers and activists, echoing the rhetoric of Islamist extremists in other parties.  Likewise, the so-called secular government became greedy to attract the Muslim vote bank of the country and for this reason they failed to stand besides the atheists. The prime minister has recently announced several times in public that being a very pious Muslim she would not tolerate anything against Muhammad and Quran. So, atheist bloggers, especially those who are on the list and who live in the country, are in danger and under attack by both sides:
1. Firstly, they are attacked by the fanatic Islamic extremists who can kill us with machete and attack us from the back, and
2. Secondly, the Government who can use ICT act 2006 (Article 57) anytime against the bloggers.
Being on the list of 84 atheist bloggers, we are under threats from Islamic extremists as well as the government. We know that anytime any Islamic extremist can hack us to death anywhere in Bangladesh. At the same time, we also know that Government can also arrest us against 57 article of ICT act 2006 for hurting religious belief whenever they want to. Under such threats and bearing the above-mentioned attacks in mind, one may wonder how terrible our current situation is? How our families can keep under current situation? Since the killing of Ananta Bijoy
Das, most of us have been keeping ourselves caged in four walls. Being the main earning members of our families we have to go to office regularly. Some of us can’t even avoid evening or night duty at work.
The horrific feeling that we and our family members endure under such death threats is hard to describe by words. We have to keep extra alert every time we are going outside and when returning home from office. As vigilantly looking around constantly, we often get scared to see any bearded-person anyone in Islamic dress. Our current situation is vulnerable and unbearable. The damage that we undergo is not only physical but also our mental health is seriously being injured. The routine of whole family has changed for last couple of months. They are afraid that they may lose us. Our parents are always in panic about us. They don’t want us to go outside home, but being the single earning–member in the family some of us have to go to office. Even staying home fails to guarantee our safety as murder in bedroom is not uncommon in Bangladesh. Moreover police can arrest us from home anytime in the name of provocative writings.

This is all-out of attack on free thinking movement in Bangladesh. Bangladesh is a Muslim majority country though the history of secularism here is pretty old. Even in the ancient philosophy and rituals, we can find the sign of secularism here. In 1971, our independence war was based on secularism, we defeated the Islamic fundamentalists. But gradually since the liberation, Islamism has been injected through dirty politics. Major political parties have counted Muslim vote banks as their main resources. Hence we are now treated by the fruit! Even so, this land never stops producing secular children. These children were brave enough not to pay any attention to the treats of the fundamentalists. Aroj Ali Matubbar, our first free thinker-writer and philosopher was arrested before the independence merely for his writings. Nonetheless, after the independence we were able to pay homage to him. After liberation, Ahmed Sharif, Daud Haider, Ali Azgar, Humayun Azad, Taslima Nasrin and many other prominent free thinkers and writers were threatened, but they did not stop. First attack on atheists in Independent Bangladesh came when Taslima Nasrin and Daud Haider were exiled from our country. Later the government of Bangladesh disallowed them to enter the country for ever. The second massive blow came when Dr Humayun Azad was severely attacked by the extremists for his last book about ‘the holy land’. We are the third generation who chose online medium for our writing, and so we are facing the third phase of attack which appeared as concerted. Still we do believe that even if they kill us the pen or keyboard will not stop. Meanwhile, we are desperately looking for a safe place in the world. Thus we dare to knock you and bother you today.

We would like to seek your help through this letter. If you know of any option or information about where we may be able to go for the time being, please will you be kind to contact us? We should be grateful to hear from you. If you have any suggestion, guideline about finding a safe home, please share with us. We would like to live and protect ourselves from the religious fanatics. We would like to keep working on mitigating the deadly affect that religious radicalists continue to create in our world. We wish to defend our writing for human rights, humanism and rationalism.

Thank you for your time and help.
